Protection of intellectual property is one of the most rapidly growing areas of business law. A company’s most valuable assets are often its intellectual property. We represent numerous clients in protecting these assets in the form of copyrights, trademarks and trade secrets, by providing clearance opinions for trademark filings, preparing copyright and trademark applications and prosecuting matters in the United States Patent and Trademark Office.
At another level of IP protection, we counsel and represent our business clients in licensing negotiations and provide licensing strategies. Our business expertise includes drafting and negotiating supply, distribution and licensing agreements in the US and abroad where trademarks, patents, copyrights or software are involved. In business transactions, we also provide due diligence in any transaction involving IP, including franchise agreements, acquisitions and sales, and secured financing. Our IP Group provides special attention to IP Management, monitoring and regularly advising our clients of changes to their IP portfolio, the costs of maintenance of rights, and the need to prune unused assets, among other things.
Our attorneys also are experienced in handling trademark, copyright and patent infringement lawsuits in federal courts all over the country. We counsel in pre-litigation investigations, including providing opinions regarding infringing uses of trademarks, service marks and trade names, preparing cease and desist letters and engaging in follow up negotiations. Finally, several of our attorneys have significant expertise in review of and obtaining insurance coverage related to copyright, trademark and unfair competition claims.
